What is Section 75 purchase protection?

Learn about Section 75 protection on eligible Zilch purchases

Section 75 of the Consumer Credit Act 1974 is a statutory protection for purchases made using credit.

In certain circumstances, your credit provider may be jointly responsible with the seller if there’s a breach of contract or misrepresentation.

Section 75 can apply to eligible purchases where the cash price of the item or service is more than £100 and not more than £30,000.

Which Zilch purchases are covered by Section 75?

Section 75 can apply when you use Zilch credit to make an eligible purchase, including when you Pay over 6 weeks or, if eligible, Pay over 3, 6 or 12 months.

Whether Section 75 applies depends on the circumstances of your purchase. Each claim is assessed individually.

When can I make a Section 75 claim?

You may be able to make a Section 75 claim if there has been a breach of contract or misrepresentation by the seller.

For example, this could be if:

  • The item is faulty

  • The item or service isn’t as described

  • The seller doesn’t provide the item or service you paid for

  • The seller goes out of business before providing your item or service

Some purchases may need additional checks. This could include purchases involving a marketplace, travel agent, payment provider or other intermediary, or purchases made for the benefit of someone else.

We’ll look at the individual circumstances of your purchase to decide whether Section 75 applies.

How do I make a Section 75 claim?

To make a Section 75 claim:

  1. Open the Zilch app

  2. Go to Purchases

  3. Select the purchase you need help with

  4. Tap Get help with this purchase

  5. Tap Dispute

We’ll ask you to provide information and evidence to support your claim. What we need will depend on the circumstances of your purchase and could include things like proof of purchase and any communication you’ve had with the seller.

We may ask you for additional information or evidence while we assess your claim.

What happens after I make a Section 75 claim?

We’ll consider the purchase, what happened, the parties involved and the supporting evidence before deciding whether Section 75 applies and whether your claim should be upheld.

Each claim is assessed individually.

Once we’ve completed our assessment, we’ll explain our decision and, where appropriate, the outcome.

Does Section 75 apply to Pay now purchases?

No. Section 75 applies to eligible purchases made using credit, so purchases made using Pay now aren’t covered.

Why might some purchases need additional checks?

Section 75 generally requires a specific relationship between you, the credit provider and the seller.

If another party is involved in the purchase, such as a marketplace, travel agent, payment provider or other intermediary, we may need to carry out additional checks.

The same can apply to purchases made for the benefit of someone else.

We’ll consider the parties involved and the individual circumstances of the purchase when assessing whether Section 75 applies.
